Description of Courses (Juris Doctor)

Basic Legal Ethics

The course gives students knowledge of the professional standards and duties of lawyers to the court, to his client, to his colleagues in the profession and to the public. In addition, the course gives students knowledge about judicial deportment considering that the administration of justice is a joint responsibility of the judge and the lawyer.

Problem Areas in Legal Ethics

This course reviews and reinforces student knowledge of important topics in Legal and Judicial Ethics. Discussion focuses on salient provisions of the Rules of Court on Legal Ethics, Code of Professional Responsibility, Notarial Practice Rule and the Code of Judicial Conduct with an emphasis on the prevailing and modern-day issues surrounding the legal profession. Problem areas will be also be highlighted by evaluating cases which aim to show the dilemma lawyers and court officers encounter in the administration of justice.

Credit Transactions

This course tackles the basic principles of credit and all other transactions involving purchases or loan of goods, services or money with a promise to pay or deliver in the future as provided in the New Civil Code and other relevant laws in Mercantile Law. This course also discusses cases and jurisprudence to equip students with legal basis which they may use as reference in understanding the Basic Principles and the subject matter.

Negotiable Instruments Law

This course is a comprehensive study of the Negotiable Instruments Law (Act 2031), and other relevant laws governing negotiable instruments and commercial documents. It also includes other related laws, jurisprudence and legal principles governing negotiable instruments and other commercial documents.

Practice Court 1

This course complies with the “Law Students Practice” under Rule 138-A of the Rules of Court, as amended by A.M. No. 19-03-24-SC dated 25 June 2019, which takes effect at the start of Academic Year 2020-2021. It deals with the limited practice of law by students certified herein, which shall cover their appearances, drafting and submission of pleadings and documents before trial and appellate courts and quasi-judicial and administrative bodies, assistance in mediation, legal counseling and advice, and such other activities that may be covered by the Clinical Legal Education Program of the law school. The students shall likewise engage in externship with the Integrated Bar of the Philippines-Leyte Chapter, government offices, law school recognized NGO’s, Law Clinic, or any supervising Lawyer or Law Firm authorized by the Law School to supervise the law student practitioner under this Rule.

No. 19-03-24-SC dated 25 June 2019, which takes effect at the start of Academic Year 2020-2021, AND A.M.  No. 19-03-24 SC (Guidelines on the Externship Program of Law Student Practitioners in Court under Rule 138-A). It deals with the limited practice of law students certified herein, which shall cover their appearances, drafting and submission of pleadings and documents before trial and appellate courts and quasi-judicial and administrative bodies, assistance in mediation, legal counseling and advice, and such other activities that may be covered by the Clinical Legal Education Program of the law school. Labor Law 1

This course aims to equip the students with the knowledge of laws, rules and regulations that set the minimum requirements for the term & conditions of employment such as wages, hours of work, monetary & welfare benefits, occupational safety & health benefit, labor standards law, & most especially on the computation of premium pay for work on rest days, special & regular holidays, overtime pay, night shift deferential pay, 13th month pay & other labor standards benefits like service incentive leave pay & service charge.

 Criminal Law 1

This course is a comprehensive appraisal of basic knowledge of Philippine Penal Laws, the relevance of legal provisions, felonies, special laws and the extent of their application including recent leading cases outlining every element of offenses and their respective penalties.

Agency, Trust and Partnership

The course deals with the laws on Agency, Trust and Partnership as provided for by the Civil Code of the Philippines, as amended; the study of the various topics in this course are based on the provisions of law and governing jurisprudence; the course includes situational applications of the law based on the various problems being encountered by the parties in Agency, Trust and Partnership; and also discussed in this course are the available legal remedies to the parties in case of breach of trust, the common element of these three topics; Agency, Trust and Partnership.

Alternative Dispute Resolution

Study of ADR System in the Philippines pursuant to RA 9285, its policies, different ADR forms as efficient tools to court diversion, and institutional and implementation of Court Annex Mediation (CAM) and Judicial Dispute Resolution (JDR) as part of the mandatory pre-trial to facilitate court decongestion per A.M.  No. 01-10-5-SC PHILJA, AC No. 20-2002, AM 04-3-15-SC PHILJA and AM 11-1-6-SC PHILJA.
